The Idaho State Controller’s Office ("SCO") operates this website (“Site”) in order to provide online access to products, services, and information (the "Service"). By accessing and using this Site, you agree to each of the terms and conditions set forth herein ("Terms of Use"). Additional terms and conditions applicable to specific areas of this Site or to particular content or transactions may also be posted in particular areas of the Site and, together with these Terms of Use, govern your use of those areas, content or transactions. These Terms of Use, together with applicable additional terms and conditions, are referred to as this "Agreement".
SCO reserves the right to modify this Agreement at any time without giving you prior notice. Your use of this Site following any such modification constitutes your agreement to follow and be bound by the Agreement as modified. The last date these Terms of Use were revised is set forth below.
1. Use of Site
For publicly accessible content whereas you are not required to provide authentication, you may use the Service, the Site, and the information, writings and/or other works that you see, hear or otherwise experience on the Site (singly or collectively, the "Content") solely for your non-commercial, personal purposes as an informational source and/or to learn about SCO products and services. Information provided by or to you in areas of this Site that require authentication may be covered under Terms of Use, policies and/or laws that would supersede the information in this document. No right, title or interest in any Content is transferred to you, whether as a result of downloading such Content or otherwise. The SCO reserves complete title and full intellectual property rights in all Content. Except as expressly authorized by this Agreement, you may not use, alter, copy, distribute, transmit, or derive another work from any Content obtained from the Site or the Service, except as expressly permitted by the Terms of Use.
2. Links to Third-Party Web Sites
Links on the Site to third party web sites or information are provided solely as a convenience to you. Such links do not constitute or imply an endorsement, sponsorship, or recommendation by the SCO of the third party, the third-party website, or the information contained therein. SCO is not responsible for the availability of any such websites. SCO is not responsible or liable for any such website or the content thereon. If you use the links to other websites provided on this Site, you will leave this SCO provided Service and will be subject to the terms of use and privacy policy applicable to those websites.
3. Linking to this Site
Unless specifically authorized by SCO, you may not connect "deep links" to the Site, i.e, create links to this Site that bypass the home page or other parts of the Site that do not contain references to SCO’s Terms of Acceptable Use and SCO’s Privacy Policy. You may not, without express written authorization from SCO, mirror or frame the home page or any other pages of this Site.
4. Downloading Files
SCO cannot and does not guarantee or warrant that files available for downloading through the Site will be free of infection by software viruses or other harmful computer code, files or programs. SCO does take reasonable measures to maintain a secure website and content to limit the spread of malicious code and viruses. If malicious code is identified you are encouraged to report it to security (AT) sco . idaho . gov immediately.
5. Disclaimer
The information provided on this Site is for your general information and use only. Neither the SCO nor any third party agency provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. The Idaho State Controller’s office takes reasonable and appropriate measures to maintain the timeliness and accuracy of information. However, data is provided from other state agencies and SCO, may not have been reviewed or audited, and my contain errors, omissions, or misstatements. Financial data is presented on a cash basis which may not fairly, completely or accurately represent the State’s financial position or the results of its operations. This may make it appear that the data is different or does not agree from other reports or information available. There are valid reasons why that is the case. For example, financial statements, such as the Comprehensive Annual Financial Report (CAFR) for the state, are prepared using a different basis of accounting than budget reports. The CAFR uses an accrual basis which includes items like accounts payable and accounts receivables, while budget reports and state revenues and expenditures are generally prepared on a cash basis, like a check book. Neither one is right or wrong. They are different by design because the underlying purpose of the information is different. When analyzing the data, it’s important to keep the various perspectives in mind to guard against drawing incorrect conclusions.

IN NO EVENT WILL SCO BE LIABLE FOR ANY DAMAGES WHATSOEVER, INCLUDING, BUT NOT LIMITED TO ANY DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR OTHER INDIRECT DAMAGES ARISING OUT OF (I) THE USE OF OR INABILITY TO USE THE SITE, THE SERVICE, OR THE CONTENT, (II) ANY TRANSACTION CONDUCTED THROUGH OR FACILITATED BY THE SITE; (III) ANY CLAIM ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE SITE, THE SERVICE AND/OR THE CONTENT, (IV) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA, OR (V) ANY OTHER MATTER RELATING TO THE SITE, THE SERVICE, OR THE CONTENT, EVEN IF SCO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IF YOU ARE DISSATISFIED WITH THE SITEWEBSITE, THE SERVICE, THE CONTENT, OR WITH THE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE SITE.
7. Indemnification
You understand and agree that you are personally responsible for your behavior on the Site. You agree to indemnify, defend and hold harmless the SCO and the State of Idaho from and against all claims, losses, expenses, damages and costs (including, but not limited to, direct, incidental, consequential, exemplary and indirect damages), and reasonable attorneys' fees, resulting from or arising out of your use, misuse, or inability to use the Site, the Service, or the Content, or any violation by you of this Agreement.
8. User Conduct
You agree to use the Site only for lawful purposes. You agree not to take any action that might compromise the security of the Site, render the Site inaccessible to others or otherwise cause damage to the Site or the Content. You agree not to add to, subtract from, or otherwise modify the Content, or to attempt to access any Content that is not intended for you. You agree not to use the Site in any manner that might interfere with the rights of third parties.
9. Password Security
If you have been issued an identification and password in order to access the Services or applications on this Site, you are responsible for maintaining the confidentiality of your member identification and password information, not writing it down in plain text, disclosing it to others, or otherwise allowing others to utilize the username and password provided to you. In order to do this, you must take reasonable procedures to ensure your password is secure, including but not limited to the following actions taken by you.
Be familiar with common attacks against individuals by attending an end-user security awareness training session, to include the following topics at a minimum:
- Email/Web Security
- Password Construction and Management
- Social Engineering
- Physical Security
- Viruses, malware and malicious code
- How to report incidents
- Make a reasonable effort to pick a good password and manage it appropriately
You agree to accept responsibility for all activities that occur under your member identification and password regardless as to whether the activities are known to you or not. SCO and the State of Idaho cannot be held accountable in any way for ignorance of basic security practices and is no excuse for non-compliance with applicable policies and laws.
10. Choice of Law/ Choice of Forum
If any part of this Agreement is determined by a court of competent jurisdiction to be invalid or unenforceable, it will not impact any other provision of this Agreement, all of which will remain in full force and effect. Any and all disputes relating to this Agreement, the SCO’s Privacy Policy, your use of the Site, the Service, or the Content are governed by, and will be interpreted in accordance with, the laws of the State of Idaho, without regard to any conflict of laws provisions.

The Idaho State Controller’s Office will do its best to answer any question or concern you may have regarding the information on this website.
